<div class="article" itemprop="articleBody">POPRAD 26. mája (SITA) - Z tohto dôvodu podala podnet na prešetrenie na Krajskú prokuratúru v Prešove. Ako ďalej za iniciatívu vysvetlil Marek Kuchta, žiadajú zrušiť predloženú zonáciu a nahradiť ju takou, ktorá bude v súlade so zákonom o ochrane prírody, teda bude obsahovať okrem projektu ochrany aj program starostlivosti.<br />

„Vzhľadom k tomu, že program starostlivosti nebol zverejnený na úradnej tabuli to považujeme za porušenie Zákona o ochrane prírody a krajiny. Nezverejnením tohto dokumentu, ktorý je povinnou súčasťou procesu, môže nastať vo vzťahu k dotknutým vlastníkom, správcom a nájomcom pozemkov, dotknutým orgánom štátnej správy, obciam a pozemkovým spoločenstvám krátenie a obmedzenie ich práv a právom chránených záujmov,“ vysvetľujú aktivisti. Pre chýbajúcu dokumentáciu tak podľa nich nemajú zonáciou dotknuté fyzické, ako aj právnické osoby na pripomienkovanie kompletné a úplné informácie, ktoré si vyžaduje legislatíva na úseku ochrany prírody a krajiny. „Nemôžu tak plne uplatniť svoje právo pripomienkovať kompletný návrh. Pre vlastníkov zároveň vzniká právna neistota, ako budú návrh zonácie a príslušné dokumenty nastavovať správu ich pozemkov,“ uviedli. Pripomenuli, že spomínaný dokument má významne dopĺňať projekt ochrany o konkrétne opatrenia na zabezpečenie dlhodobej priebežnej starostlivosti o chránené územie a jeho ochranné pásmo vrátane finančných nákladov.<br />

Problematický podľa My sme les nie je len chýbajúci program starostlivosti, ale celý návrh novej zonácie TANAP-u. Ten podľa nej zásadne znižuje úroveň ochrany nášho najstaršieho národného parku. Upozorňuje, že materiál vypracovaný Správou TANAP-u nielenže nezodpovedá zákonným požiadavkám, ale ignoruje aj rozhodnutie Európskeho súdneho dvora a nové míľniky Plánu obnovy. „Návrh nezaraďuje tisícky hektárov starých lesov a biotopov hlucháňa hôrneho do prísne chránenej zóny A, hoci to vyžaduje Plán obnovy a odolnosti,“ priblížili ochranári. Zároveň pripomenuli, že Európska komisia minulý týždeň formálne upozornila Slovensko, že po prehratom súdnom spore o ochranu hlucháňa hôrneho neprijalo potrebné opatrenia. V prípade nečinnosti hrozia Slovensku státisícové pokuty denne.<br />

Envirorezort pripravil návrh zonácie Tatranského národného parku v spolupráci so Správou TANAP-u po viac ako dvadsiatich rokoch. V súčasnosti je v pripomienkovom konaní na Okresnom úrade v sídle kraja v Prešove. Projekt podľa ministerstva počíta so zväčšením výmery národného parku zo súčasných 73 800 hektárov na 74 075 hektárov. Takmer polovicu novej výmery, 34 777 hektárov, pritom majú tvoriť územia s najprísnejším, teda piatym stupňom ochrany.</div>
